§ 1-1-501 Rape
A person commits rape if he or she engages in sexual intercourse or deviate sexual activity with another person:
(a) By forcible compulsion;
(b) Who is incapable of consent because he or she is:
(1) Physically helpless;
(2) Mentally defective;
(3) Mentally incapacitated;
(4) Is a minor;
(5) Is an animal or wildlife.
Violating this subsection is a Class (A) Felony.
